2. ACCOUNTS

2.1. You must be 18 years or older to use this Service. If in case of you’re below the age of 18 years then adult supervision is required to set up an account with us. You must provide your full legal name, current address, a valid email address, a valid phone number, and any other information needed to complete the signup process.

2.2. You are responsible for keeping your password private and secure. IMAAD PERFUMES cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.

2.3. You may not use any tools or services provided by IMAAD PERFUMES for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of India.

2.4. You are responsible for your password, Email ID and billing/shipping addresses registered with us. You must not knowingly transmit any worms or viruses or any code of a destructive nature for which strict legal actions will be undertaken by the company.

2.5. A breach or violation of any of the Account Terms as determined in the sole discretion of IMAAD PERFUMES will result in an immediate termination of your account and services. In case of any disputes, the law applicable to the region i.e., in Bengaluru, The State of Karnataka, India.

2.6. You may cancel your account at any time by emailing customercare@imaadperfumes.com by stating the reason for cancellation.

2.7. If you cancel the account in the middle of your purchase, you will receive one final invoice via email. Once that invoice has been paid you will be asked for a final confirmation to delete your account.

2.8. We reserve the right to modify or terminate our service for any reason, without notice at any time. Fraud: Without limiting any other remedies, we may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site. Strict Legal action will be taken accordingly.

 

3. PURCHASE

3.1. If you order a Product to which a minimum age requirement applies, by ordering that Product you confirm that you are of the required age. If we reasonably believe that you are not legally entitled to order a Product, we reserve the right to cancel your order 

3.2. If you select a shipping destination in the regions, please go through the Terms and Conditions thoroughly which shall apply to your purchase and use of the Website.

3.3. Use of the website is available only to persons who can form legally binding contracts under applicable law. Persons who are “Incompetent to Contract” as per Local Contract Acts are not eligible to use the website.

3.4. If you are a minor (i.e. under the age of 18 years), you may use this website only under the supervision of a parent or legal guardian who agrees to be bound by these terms of use.

3.5. Electronic invoice will be created on every purchase and holds a right to product and service and a hard copy will be given during the time of delivery.

3.6. if the invoice does not match with the product you hold a right to return and refunds to your Imaad wallet immediately

 

4. PRICES

4.1. All prices of Products on the Website are the prices for the Products only.

4.2. IMAAD PERFUMES may vary the prices of Products listed on the Website at any time and without any notice but such changes will not apply to Products that have been sent via a Dispatch Confirmation.

4.4. All promotion prices will be notified during the offers for a limited period as indicated on our website or other channels.

4.5. Any change of price during delivery will be notified and will be informed through SMS and email if any change in price from PURCHASE INVOICE contact us on customercare@imaadperfumes.com

 

5. PAYMENT

5.1. CASH ON DELIVERY (COD) (NOT AVAILABLE IN INDIA)

5.1.1. The total cost of your order will be the purchase price for the products (which you pay us) plus any delivery charge if mentioned during the checkout process. Find out more about Shipping Destinations, Weight, Costs, and Delivery Times on our website.

5.1.2. We may accept payment in cash (COD) for the specified region of your selected shipping destination in our payment section outside India if indicated.

5.1.3. The payment option of Pay on Delivery is available for selected regions outside India.

5.1.4. Cash on Delivery can be used as a payment method for selected regions depending on shipping policies outside India if indicated.

5.1.5. Convenience fees will be charged on orders placed using Pay on Delivery if applicable.

5.1.6. The order amount has to be paid in full before receiving the package and signing the delivery sheet. The package can be opened only after the payment is made in full.

 

5.2 ONLINE PAYMENT

5.2.1. You confirm and agree that the debit card or any other payment method that is being used is yours and that all details you provide to us with respect thereof including, without limitation, name, and address details are complete, legal, correct, and accurate. You further confirm that the debit card is valid and the input payment details are correct. All debit cardholders and payment ACCOUNT holders are subject to validation checks and authorization by the card issuer or payment method provider. If the issuer of your card or payment method refuses to authorize payment, we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal.

5.2.2. We are not responsible for any charges or other amounts which may be applied by your card issuer or bank or payment method provider as a result of our processing of your debit card payment or another method of payment following your order.

5.2.3. If your debit card or payment method is not denominated in the currency of your PURCHASE INDICATED on the Website, the final price may be charged in the currency of your card or account. Such final price is calculated and charged by your card issuer or bank or payment method provider and therefore we shall not be responsible for any extra cost, expense, charge, or other liability which may be incurred or suffered by you as a result of your card issuer or payment method provider charging you in a different currency other than the currency of your purchase as displayed on the Website.

 

6. INVOICING

6.1. Where we elect or are required by applicable law, to issue or make available an invoice, we reserve the right to issue or make available electronic invoices and you agree to such form of INVOICING.

6.2. Hard copy of INVOICE is given during the time of delivery for further references if need be.

 

7. SHIPPING 

7.1. We currently deliver the products pan India and outside India if indicated. For further clarification please contact our customer care team

7.2. Delivery charge varies with each order basis various logistics partners who will fulfil the shipment. Please review the delivery charges on every order you place.

7.3. Our courier/logistics partners may have a holiday in between when you placed the order or the delivery date may change as some courier partners do not work on Sundays and this is factored in to the delivery dates.

7.4. Depending on the availability of our logistics partners we can deliver across INDIA & beyond

7.5. Estimated delivery time depends on the following circumstances:

1. Product’s availability with the Imaad Perfumes
2. The destination to which you want the order shipped to and location of the customer.
3. Business days exclude public holidays and Sundays.

7.6. Orders received after any specified “cut off” or “last order” time or received on a day which is not a working day estimated delivery times will be CALCULATED from next business day

7.7. As part of the ordering process, you will be contacted for the supply of goods by our shipping/logistics partners. Upon placing an order, you will receive various email confirmations/text alerts concerning your order. In respect of each of these and any other similar email confirmation, please note that references to shipping; express courier; shipping and handling, and any other similar terms related to the services performed by our shipping partners.

7.8. Delivery information such as Customer Name, Location Address, and Contact Number will be stored for delivery purposes. Other personal identifiable information will not be stored.

 

8. CANCELLATION RETURNS AND REFUNDS.

8.1. If you should wish to cancel or return any Products, you may only do so following our Returns & Cancellation Policy. This return and cancellation policy does not affect your statutory rights as a consumer distance selling legislation or e-commerce regulations in the region to which the product is shipped (“Regulations”).

8.2. When you return a Product under the Regulations we will issue you with a full refund to your IMAAD WEBSITE wallet but you will need to return the Product at your own cost (if you have already received the Product) unless otherwise specified by our customer care team or as mentioned in our returns and cancellation policy.

8.3. Return will be processed only if it is determined that the product was not damaged while in your possession. And a refund will be issued in your IMAAD WEBSITE wallet via your registered id.

8.4. The product is different from what was shipped to you.

8.5. The product is returned in the original condition.

8.6. Once we receive your return or the warehouse notifies us of receipt of the return, as the case may be, a refund is issued to your IMAAD WEBSITE wallet.

8.7. Refunds will not be processed in cash. Refunds can be processed only in your IMAAD WEBSITE wallet.

8.8. If the payment method, which you used to make the payment (such as card, UPI, net banking etc) at the time of purchase, is not valid for refunds, instead, a refund will be issued in your IMAAD WEBSITE wallet.

 

9. REPLACEMENT

9.1. Items within the return window and in stock (same item) with the same are eligible for a free replacement. The free replacement order will be shipped through standard shipping once the original order is returned. Free replacements can be requested if the following conditions apply:

• Item received is physically damaged;
• Item received has missing products
• Items received are different from their description on the product detail page on www.imaadperfumes.com
• Item received is defective/does not work properly.

 

10. WALLET

10.1. With IMAAD PERFUMES, you hold an account of the transaction via the IMAAD WEBSITE wallet where you can add and use it for buying products with us.

10.2. The wallet contains all your transaction availability of virtual money with us.

10.3. Any refunds, cancellation, and returns money will be added in the wallet.

10.4. The wallet cash holds a secure authorization with your account and password.

 

11. COPYRIGHT

The copyright subsisting in all images and other materials produced for the sale of the products is owned by IMAAD PERFUMES (IP), and any such images or other materials shall not be used by customers (Purchasers) without obtaining Company’s (IP’s) prior consent in writing, and the Company (IP) will have the right to use any such images in its discretion for the sale of its products. During the period in which the products are protected by copyright, the copyright remains with its author (or any person to whom that right has been assigned). Customers (Purchasers) are only purchasing the products, but not the right to produce copies of the products (including photographs thereof) for publication. If such rights are sought, you should contact the copyright owner.

 

12. What personal data we collect and why we collect it

12.1. Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

 “Intellectual Property Right (IPR)” means any patent, copyright, moral right, trademark, service marks, logos, commercial names, logo identity, logo guidelines, domain names, patents, designs, business processes, semiconductor topography rights or industrial property, know-how, software, programs, process, source code, concept, idea, systems, process flow, inventions, formulae, confidential or secret processes, trade secrets, any other protected rights or assets and any other intellectual property right arising under any Applicable Laws and all ancillary and related right, including all rights of registration and renewal and causes for action for the violation, misappropriation or infringement of any of the foregoing.

BUYER solely for the express purposes described in this policy during the Term of this transaction. For the avoidance of doubt, the BUYER will not:

(i) copy, reproduce, modify, adapt, translate, reverse engineer, make alterations, decompile, disassemble, or make derivative works or improvements based on any Imaad Perfumes IPR or use, rent, loan, sublicense, lease, distribute, or attempt to grant other rights to Imaad Perfumes IPR; or

(ii) use any Imaad Perfumes IPR to act as a consultant, service bureau or application service provider, or to permit remote access to any Imaad Perfumes IPR

(iii)The publication, reproduction, display, modification, distribution or transmission of Imaad Perfumes Material or Imaad Perfumes Product listing and the BUYER will not infringe, misuse, dilute, misappropriate, or otherwise violate any Intellectual Property Rights of Imaad Perfumes

(iv) Imaad Perfums Products shall be gifted/sold only in their original packages. BUYER shall not, either directly or indirectly, relabel, repackage, mark, or assist any other entity to relabel, repackage, or mark Imaad Perfumes Products except as may be specifically approved by Imaad Perfumes in writing via a Binding Legal Agreement.

14. Imaad Perfumes website Account

BUYER/Customer will not use Imaad Perfumes website, Imaad Perfumes website Account or Storefront to violate the security of, or gain unauthorised access to, any computer or computer network or other device or system (including unauthorised attempts to discover passwords or security encryption codes to use any robot, spider, site search or retrieval application or other devices to retrieve or index any portion of the website, collect any information about other users (including usernames or email addresses); or to reformat or frame any portion of our website), or use the website, buyer Account, Storefront or any other Material, intentionally or unintentionally, to violate any Applicable Law.

15. INDEMNIFICATION

15.1 BUYER/CUSTOMER (“Indemnifying Party”) will defend, indemnify and hold harmless Imaad Perfumes, Imaad Perfumes Connected Properties and their Affiliates and their respective employees, directors and representatives (“ Indemnified Party”) from and against any and all claims, costs, losses, damages, judgments, penalties, interest and expenses (including reasonable attorney’s fees) arising out of or in connection with (i) a breach of any of the representations, warranties, covenants or undertakings of the Indemnifying Party (ii) any claims relating to or based on (a) any actual or alleged breach of any term of this policy by the Indemnifying Party including the offer, sale, fulfilment, refund, or return thereof any actual or alleged infringement of any Intellectual Property Rights by any of the foregoing or its submissions, posting of materials or deletion thereof, and any personal injury, death, damage to property related thereto; 

15.2 Imaad Perfumes reserves the right to change, upgrade, modify, limit or suspend our services or any of its related functionalities or applications at any time temporarily or permanently without prior notice. Imaad Perfumes further reserves the right to introduce new features, functionalities or applications to the services or to future versions of our products & services. All new products or features, functionalities, applications, modifications, upgrades and alterations shall be governed by this policy, unless otherwise expressly stated by Imaad Perfumes.

15.3 Imaad Perfumes reserves the right to change, upgrade, modify, limit or suspend Marketplace services or any of its related functionalities or applications at any time temporarily or permanently without prior notice. TUL further reserves the right to introduce new features, functionalities or applications to the services or to future versions of the Marketplace services. All new features, functionalities, applications, modifications, upgrades and alterations shall be governed by this Agreement, unless otherwise expressly stated by TUL.

15.4  BUYER/CUSTOMER acknowledges that this policy and the relevant Imaad Perfumes Legal Policies may not cover all issues that may arise in connection with a BUYER Transaction. BUYER agrees and accepts that Imaad Perfumes shall have the right to modify or supplement our Policies at any time without notice. BUYER further agrees and accepts that Imaad Perfumes shall have the right to make determinations wherever Imaad Perfumes considers appropriate having regard to the evidence received by Imaad Perfumes and interests of both BUYER and Imaad Perfumes regardless whether the issue in question has been expressly addressed in the Imaad Perfumes Policies or in this document.

15.6 In case of any dispute in connection with any Seller Transaction, the books and records of Imaad Perfumes shall take precedence and be conclusive.

15.7 The Shipping Charges, payment details, date, period and mode of delivery, warranties related to Imaad Perfumes Products if any, shall depend upon and be the responsibility of the Logistics Partners or Payment Gateway Providers and Imaad Perfumes shall not be liable in any manner.

15.8 BUYER acknowledges and accepts that Transactions between Imaad Perfumes and Buyer or other participants, the BUYER releases and discharges Imaad Perfumes from any claims, disputes, demands, liabilities and damages, of any nature (whether direct, indirect, actual or consequential), arising out of or in relation to or in connection with any 3rd Party or Partner Transactions.

15.9 BUYER/CUSTOMER, for itself and its successors, affiliates, subsidiaries, officers, employees, shareholders, assignees or other Person or entity claiming through, by or for the BUYER, release and discharges forever Imaad Perfumes and all of its predecessors, successors, Imaad Perfumes affiliates, its partners, subsidiaries, directors, officers, employees, shareholders, agents, representatives, attorneys, assignees, whether past or present and acting or claiming through, by or for Imaad Perfumes, from any and all claims, disputes, demands, liabilities, damages, losses, debts, obligations, legal or judicial proceedings (including suits), causes of action or any rights of any kind or nature, whether accrued or unaccrued, arising or resulting from or related to the shipment or delivery of Imaad Perfumes Products to Buyers including tax registration or collection obligations.

15.10 Imaad Perfumes will not be liable (whether in contract, warranty, tort, (including negligence or product liability) or otherwise) to the other Party or any other person for the cost of cover, recovery or recoupment of any loss of profit, revenue, business, or data or punitive or indirect or consequential damages arising out of or relating to any sales or transactions or this policy, even if such Party has been advised of the possibility of such costs or damages. The total liability whether arising out of any breach of contract, warranty, tort or otherwise under or in connection with this policy or the transactions contemplated hereby shall not exceed the aggregate sum of Imaad Perfumes product price received by Imaad Perfumes from the relevant sale transaction only if accepted by Imaad Perfumes for further processing.

16. CONFIDENTIALITY

The BUYER agrees and undertakes that during the Term of this transaction and thereafter, the BUYER shall keep all data confidential, and information disclosed and divulged by one Party to another Party or which comes to its knowledge whether in print, digitalised, any other electronic form, oral or software format, whether or not marked “Confidential” (“ Confidential Information”) strictly confidential. Confidential Information will include without limitation lists, new product information, price information, launch date, projections, plans, forecasts, financial, business and sourcing information, analytics, designs, specifications, software, techniques, technology, passwords and other non-public information obtained from Imaad Perfumes.

17. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement/Policy/Policies shall be governed by and construed in accordance with the Indian laws. The competent courts in Karnataka shall have exclusive jurisdiction in all matters or disputes arising out of this Agreement/Policy/Policies only if deemed fit & accepted by Imaad Perfumes.

“Applicable Law” shall mean all applicable Indian laws, statutes, ordinances, rules, regulations, guidelines, policies and other pronouncements including amendments thereof having the force of law by Central, State, municipality, court, tribunal, Governmental Authority, ministry, department, commission or any judicial forum.
